1. Introduction

MochaCare ("we," "us," or "our") operates the MochaCare platform, including our website at mochacare.com and our staffing management application (collectively, the "Service"). MochaCare is a software-as-a-service (SaaS) platform that provides AI-powered staffing and workforce management tools to home care agencies ("Agency Customers"). Our Agency Customers use our platform to manage hiring, scheduling, dispatch, compliance, and communications with their caregivers, applicants, and staff ("End Users").

This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with our Service. It applies both to Agency Customers who use our platform and to End Users whose information is processed through our platform on behalf of Agency Customers.

2. Our Role

MochaCare acts as a service provider and data processor on behalf of our Agency Customers. When an Agency Customer uses our platform to collect applicant information, manage caregiver records, or send text messages, the Agency Customer is the party responsible for that data and those communications. MochaCare processes this data on the Agency Customer's behalf and according to their instructions.

3. Information We Collect

From Agency Customers

When an agency signs up for MochaCare, we collect account registration information such as the business name, contact name, email address, and phone number of agency administrators and staff who access the platform.

From End Users (on behalf of Agency Customers)

When caregivers or applicants interact with our platform (for example, by submitting a job application or completing onboarding steps), our Agency Customers collect information through our tools. This may include names, email addresses, phone numbers, employment history, professional certifications and licenses (such as HCA status, TB test results, and driver's licenses), interview recordings and transcripts, and other information submitted through application forms or document uploads. This data is collected by and belongs to the Agency Customer. MochaCare processes it on their behalf.

Information Collected Automatically

When anyone accesses our Service, we may automatically collect certain technical information, including IP addresses, browser type and version, device information, pages visited, and cookies and similar tracking technologies.

4. How We Use Information

We use information for the following purposes: to provide, operate, and maintain our platform for Agency Customers; to process data on behalf of Agency Customers, including managing hiring pipelines, facilitating AI-powered and human interviews, and storing compliance documents; to enable Agency Customers to send operational communications (including SMS messages) to their caregivers and applicants through our platform; to improve, personalize, and expand our Service; to provide customer support to Agency Customers; to detect, prevent, and address fraud, abuse, or technical issues; and to comply with legal obligations.

5. SMS/Text Messaging

MochaCare uses SMS and voice calls in two ways:

Messages to Agency Customers: MochaCare may send text messages or make calls directly to Agency Customer staff for platform alerts, account notifications, urgent staffing updates, system status notifications, and other operational communications related to their use of our Service.

Messages to End Users (on behalf of Agency Customers): MochaCare also provides messaging tools that Agency Customers use to communicate with their caregivers and job applicants. When an Agency Customer sends text messages through our platform, the Agency Customer is the sender of those messages and is responsible for obtaining proper consent from recipients. These messages may include shift notifications and scheduling updates, shift coverage and replacement requests, interview scheduling confirmations and reminders, job application status updates, document submission reminders for compliance items, and other staffing-related operational communications.

Message frequency varies based on End User activity and the Agency Customer's use of the platform. Message and data rates may apply. End Users can opt out of receiving SMS messages at any time by replying STOP to any message. For help, reply HELP. For more details, see our SMS Terms of Service.

We do not sell, rent, or share End User phone numbers or SMS opt-in data with third parties for marketing purposes. SMS consent is not a condition of purchasing any goods or services.

6. How We Share Information

We may share personal information in the following circumstances: with Agency Customers, who own and control the End User data collected through our platform; with sub-processors and service providers who assist us in operating our platform (such as cloud hosting, communication, and analytics providers) under contractual obligations to protect data; if required by law, regulation, legal process, or governmental request; to enforce our terms of service or protect the rights, property, or safety of MochaCare, our customers, or the public; and with consent or at the direction of the Agency Customer.

We do not sell personal information to third parties. We do not use End User data collected on behalf of Agency Customers for our own marketing purposes.

7. Data Security

We implement industry-standard security measures to protect personal information, including encryption of data in transit and at rest, access controls and authentication, regular security assessments, and secure cloud infrastructure. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Data Retention

We retain Agency Customer account data for as long as the account is active or as needed to provide our Service. End User data processed on behalf of Agency Customers is retained according to the Agency Customer's instructions and our data processing agreement. When an Agency Customer terminates their account, we will delete or return their data in accordance with our agreement. 9. Your Rights

Agency Customers can access, correct, or delete their account information at any time through the platform or by contacting us.

End Users who wish to access, correct, or delete their personal information should contact the home care agency they applied to or work with, as that agency controls their data. If you are unable to reach the agency, you may contact MochaCare at pranav@mochacare.com and we will assist in directing your request.

Depending on your location, you may have additional rights under applicable privacy laws, including the right to data portability and the right to opt out of certain data processing.

10. Cookies

We use cookies and similar technologies to enhance your experience, analyze usage patterns, and improve our Service. You can control cookie preferences through your browser settings. Disabling cookies may affect certain features of the Service.

11. Children's Privacy

Our Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child without parental consent, we will take steps to delete that information.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify Agency Customers of material changes by posting the new policy on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated policy.
